Pearson Warshaw, LLP is pleased to announce that Rachel Soffin has been appointed by the United States District Court for the Northern District of Illinois as interim class counsel for consumers in In Re: Bestway Above-Ground Pools Litigation.

This class action involve millions of allegedly defective above-ground pools designed, manufactured, and sold by Defendant Bestway for approximately $400 to over $1,000, which Plaintiffs allege were subject to a delayed, deficient, and inadequate recall. Plaintiffs allege that Bestway designed, manufactured, marketed, and sold the Pools with external “compression straps” located outside of the vertical support poles, creating an accessible foothold that allowed children to climb into the pool, resulting in fatal drownings. Plaintiffs further allege that Bestway had notice of the hazard for years through prior incidents and litigation, yet continued to market the Pools as safe, and failed to issue timely warnings, redesign the product, or provide an adequate remedy.

As interim co-lead class counsel, Ms. Soffin will play a key role in directing litigation efforts, coordinating with co-counsel, and ensuring that the interests of the class are vigorously represented. The Court’s appointment is recognition of Pearson Warshaw’s extensive experience in consumer class action litigation.
